Runaway verdicts continue to be a concern for the business and insurance community – from 2014 to 2018, plaintiff awards in the United States almost doubled in total dollar amounts, with a few exceeding $1 billion.  Media coverage and advertisement of these verdicts may motivate increased litigation that, in turn, creates an increased litigation burden on companies and carriers.  This CLE session will cover recent substantive developments in the law, with a focus on the proliferation of runaway verdicts in New England, factors fueling this trend, as well as defense approaches to the same.
